Section 60i Certificates
The Family Law Act 1975 requires that parents that are not in agreement about their child’s parenting arrangements must attend mediation. They must also obtain a Certificate of Attendance (Section 60i Certificate) before an Application for a parenting Order, can be made to the court.
Information
The types of section 60i certificates, which may be issued by Family Dispute Resolution Practitioners are:
Certificate A If there was a refusal to attend;
Certificate B If the Practitioner considered the matter inappropriate for Family Dispute Resolution;
Certificate C If a genuine attempt was made to resolve the dispute.
Certificate D If a genuine attempt was not made to resolve the dispute.
Certificate E If the Practitioner considered the matter unable to continue through Family Dispute Resolution.
Certificate B If the Practitioner considered the matter inappropriate for Family Dispute Resolution;
Certificate C If a genuine attempt was made to resolve the dispute.
Certificate D If a genuine attempt was not made to resolve the dispute.
Certificate E If the Practitioner considered the matter unable to continue through Family Dispute Resolution.
When filing an Application, the court requires that a copy of the Section 60i Certificate be filed with the court Application. This is unless the court is satisfied that an exemption applies. There are very limited reasons why a Court would accept an Application for filing, without a Section 60i certificate.
