What steps are involved in instructing a family law solicitor and seeing that a recovery order is made?

If you are planning to apply for a recovery order, please continue reading to understand the steps involved in the process.

Preparing Court Documents

The first step is to prepare your court documents to get you into court. We need to explain to the Judge or Senior Judicial Registrar what makes your case urgent and why it is appropriate for the court to urgently consider your matter and ensure your children return home safely. This involves preparing your application, accompanied by your Affidavit and other supporting documents to establish both urgency and risk.

Urgent Consultation

At Genuine Legal, we strive to prepare those documents with you and consult with you urgently to get your matter into court as soon as possible. Once filed, the court must consider whether your case is indeed urgent, making the proper preparation of these materials essential.

Chambers Hearing Process

Your materials will be reviewed in what is called a ‘Chambers Hearing,’ which takes place behind closed doors. A Deputy Registrar of the Court will consider the urgency of your case and decide how quickly it can be addressed. If successful, your matter may be put before an appropriate Judicial Officer, such as a Judge or Senior Judicial Registrar, within a few days to a week of your application being filed.

Timeline for Consideration

If your case is not deemed urgent, you might wait between four to six weeks before it is ultimately heard. This underscores the importance of preparing your documents quickly but correctly to ensure your children receive the assistance they need as soon as possible.

Advocacy on Your Behalf

Once your matter is heard, you may require an advocate on the day to represent your interests and those of your children. Here at Genuine Legal, we aim to provide that advocacy for our clients, rather than briefing a Barrister for an additional cost. We want to ensure you receive timely assistance that is also cost-effective.

Our Commitment

At Genuine Legal, we have the experience necessary to guide your matter in the direction it needs to go, within the timeframe required.

If you need our assistance with a recovery order, please feel free to call on 0721134645 to book an initial consultation with one of our experienced Solicitors.
