Most people wonder what will happen when they commence their proceedings in the Federal Circuit and Family Court of Australia. We understand that it can be confusing and complicated if you have never been involved in family law proceedings before. We have outlined answers to a few FAQs below.

Can the Court make a decision on a final basis for my matter straight away?

Lots of people wonder whether a decision will be made on a final basis straight away or what will be the next steps. Essentially, when you file your application with the courts, it will automatically be listed for a Directions Hearing.

What is a Directions Hearing?

A Directions Hearing will be held so that the parties can file their material and they can try to come to an agreement about what will happen from then on in. Directions is, as the name would suggest, the directions for the matter. So if it’s a parenting matter, there might be a family report. On the other hand, if it’s a property matter, there might be property orders made for disclosure.

What if there are issues in my matter that need to be addressed urgently?

Otherwise, the court will list it for an Interim Hearing if there are urgent issues that need to be determined. An Interim Hearing is a different matter and that’s where arguments are made by the parties about what should be happening for their arrangements moving forward.
